for Ballooning
Bergdorf Priesteregg GmbH arranges balloon flights with Flaggl Ballooning GmbH. In this case, Flaggl Ballooning GmbH is the organizer of the service and the contractual partner of the passenger. The entrepreneur/pilot listed on the flight ticket (transport contract), which is handed to the passenger before the flight, is considered the organizer and contractual partner.
All flight services provided by Flaggl Ballooning GmbH are subject to Austrian law, aviation regulations, and the following conditions.
1. Pre-Flight Requirements
Before the flight, the passenger (or a legal guardian/adult companion if children are flying) must carefully read the transport contract and confirm it with their signature. Shortly before takeoff, the pilot will provide a safety briefing regarding the launch procedures. If the passenger does not understand this briefing or requires further explanations, they must immediately inform the pilot.
2. Obligation to Report Health Restrictions
Passengers must inform the pilot in advance of any physical limitations. Conditions such as heart disease, motion sickness, spinal or disc problems, psychological disorders (such as loss of consciousness), high blood pressure, etc., must be reported. Additionally, passengers must disclose any alcohol consumption within the past 12 hours. If the passenger has suffered a serious accident within the past 12 months, this must also be reported to Flaggl Ballooning GmbH. In case of uncertainty about flight suitability, Falken Air is responsible for informing passengers about all necessary requirements.
3. Insurance & Liability
To cover all passenger claims under the liability provisions of Austrian aviation law, the respective pilot has taken out insurance. Any claims exceeding the legally prescribed coverage limits are explicitly excluded from liability.
Passengers must properly secure or store any items they bring on board (such as cash, mobile phones, cameras, glasses, and other valuables). Flaggl Ballooning GmbH assumes no liability for lost or damaged items. Additionally, the pilots of Flaggl Ballooning cannot be held responsible for any damages or accidents occurring on the way to the launch site or from the designated meeting point.
The exclusion or limitation of liability also applies to the benefit of the pilots and authorized representatives of Flaggl Ballooning GmbH. Flaggl Ballooning pilots are only liable for damages if they result from gross negligence or intentional misconduct by the tandem pilot. The liability of Flaggl Ballooning GmbH for passenger belongings is limited to the amount covered by the applicable insurance. Claims exceeding this amount can only be asserted in cases of intent or gross negligence.
6. Equipment
The passenger agrees to participate in the balloon flight only with appropriate clothing (weather- and windproof clothing, suitable for dirt), ankle-high, sturdy hiking boots, as well as gloves and sunglasses.
7. Booking & Payment
Flaggl Ballooning GmbH offers balloon flights all year round. The passenger declares that participation in a balloon flight is solely for personal interest. If a confirmed booking is not honored, the full fee for the flight must be paid.
The pilot determines the execution of the flight and is always responsible for conducting the flight. We explicitly point out that, despite fixed appointments, there is no entitlement to the flight if prevailing weather conditions do not permit it. In case of rescheduling or last-minute cancellations, there is no entitlement to compensation, reimbursement, or refund of any incurred expenses. However, the right to reschedule the flight remains.
Weather-related cancellations do not require proof—only the professional assessment of the responsible pilot is sufficient.
The stated flight duration is an estimate and may vary. The flight route, landing site, and flight times may change at any time, especially for safety or operational reasons, without entitling the passenger to compensation.
When booking a balloon flight, the flight price must be paid along with the hotel invoice to Bergdorf Priesteregg GmbH.
8. Cancellation Fees
The passenger may cancel the agreed flight appointment at any time by email to **bergdorf@priesteregg.at**. Cancellations up to **4 days** before the scheduled flight are free of charge. From **3 days to 24 hours** before departure, a **50% cancellation fee** applies. Vouchers and tickets become invalid upon cancellation and will only be reactivated after receiving the cancellation payment. A refund of the remaining purchase price is not possible. For cancellations **within 24 hours**, a **100% cancellation fee** applies.
9. Use of Photo & Video Material
The passenger agrees that all photo and video recordings taken during the tandem flight may be used unrestrictedly by Flaggl Ballooning. Copyright remains with Flaggl Ballooning.
10. Risk Advisory
We emphasize that, despite the utmost care, accidents with significant injuries (e.g., sprains, bone fractures, spinal injuries, concussions, or in extreme cases, death) cannot be ruled out when ballooning. The risk is particularly high during takeoff and landing due to improper landings, missteps, or falls.
11. Final Provisions
By signing the flight ticket, a contract is established between the passenger and Flaggl Ballooning GmbH. All disputes shall be governed exclusively by Austrian law. The place of jurisdiction is the competent district or regional court for Graz. If any provisions of these terms are deemed invalid, the validity of the remaining provisions remains unaffected.
